Terms of Service

1. Description of Service

FleckCal is a calendar and event management application that allows you to create events, manage invitees, sync with Google Calendar and Microsoft Outlook, generate meeting links (Google Meet and Microsoft Teams), and send event invitations via SMS, WhatsApp, and email.

2. Account Registration

You must provide accurate and complete information when registering for an account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 4 years old (or the applicable minimum age in your jurisdiction) to use the App.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Send spam, unsolicited messages, or abusive content through the App's invitation features.
• Use the App to harass, intimidate, or harm any person.
• Attempt to access, tamper with, or disrupt the App's systems, servers, or data.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App to send invitations to people without their consent or for fraudulent purposes.
• Resell, sublicense, or redistribute access to the App without our written permission.

4. Messaging and Invitations

When you send event invitations via SMS, WhatsApp, or email, you are solely responsible for the content of those messages and for ensuring you have the recipient's consent to contact them. You must comply with all applicable messaging laws and regulations, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and WhatsApp's policies. We reserve the right to suspend or terminate accounts that violate messaging policies.

5. Third-Party Integrations

The App integrates with Google Calendar, Google Meet, Microsoft Outlook, Microsoft Teams, and WhatsApp. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third-party services. You are responsible for maintaining the necessary permissions and accounts with these services.

6. User Content

You retain ownership of the content you create in the App, including events, invitee information, and contacts. You grant us a limited license to process and store your content solely to provide the App's services. You are responsible for ensuring you have the right to store and share any personal data you enter into the App, including invitee phone numbers and email addresses.

7. Data and Privacy

Our collection, use, and protection of your data is described in ourPrivacy Policy, which is incorporated into these Terms by reference. You are responsible for reviewing the Privacy Policy to understand our data practices.

8. Service Availability

We strive to keep the App available at all times but do not guarantee uninterrupted access. We may temporarily suspend the App for maintenance, updates, or technical issues. We are not liable for any downtime, data loss, or service interruptions.

9. Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of or inability to use the App.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights, including sending unsolicited messages to invitees.

11. Account Termination

You may delete your account at any time by following the instructions on ourData Deletionpage. We may suspend or terminate your account if you violate these Terms or if we believe your activity poses a risk to the App or other users.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App and updating the "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state in which FleckLabs operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the applicable courts.
